How to Avoid a False Rape Accusation

On today’s episode of the Danger & Play podcast we talk to a former criminal defense attorney who has actually represented men falsely accused of rape. Yes, that’s right. This isn’t some twenty-something kid giving you advice based on stuff he read on the Internet. This is real deal advice from someone who has been there and done that.

In this segment we talk about how the legal system really works. Learning the truth about how police interview suspects may surprise you.

By the way, here’s the case I mentioned in the podcast: Real Life Date Rape Case

I don’t live in USA, but this stuff is great. Def. do more of this, maybe a series?

    • Danger & Play Blog

      It’s looking that way.

  • Aurini

What if you say to the cop: “Don’t try and pull that fast talk with your social and intellectual better you degenerate, you filthy pile of dirt.”

    • Aurini

*I live in Calgary, and we’ve got some of the most cowardly, criminal, and dangerous cops I’ve seen in Canada. I hold them in utter contempt.

    • Danger & Play Blog

“Choose your enemies carefully,” the masters all say.

  • Deliberate Danger

Approximately what are the odds of being falsely accused of rapes? How common is this? I could be paranoid, but this topic seems to be a big issue on manosphere.

    • Danger & Play Blog

Probably as common as being mugged at gun point – no so common that you hide in your house but common enough (and with disastrous enough consequences) that you had better anticipate the problem well in advance.

  • Typical Male

This is a super important topic and is worth doing a whole number of episodes on. From just the short intro you gave, I wondered how one would even know what the cop was coming by to talk about. My first instinct would be to ask the cop what he wanted.

Leaving aside false rape, should I ask for a lawyer anytime a cop shows up at my front door? He could be just asking me about the next door neighbor or something.

    • Danger & Play Blog

Cops don’t come over because they want to be your friend.

    • KP

For starters, don’t invite him inside. If you have a screen door, keep it closed and talk to him through that. If you don’t, step outside to be with him there and close your door behind you.

And above all, remember that anything you say may be introduced against you.

  • DoubleLongDaddy

On this topic, im 17 and the last 6 months have been hell, so to the guys that think this is not gonna happen to you, wait till your fucking principal or dean fucking brings you in with a pile of copied facebook convo pages and asking you to explain what did you mean when you wrote ” do you like 2 fingers or 3″ or ” was your dad home when i fucked you in the toilet”. On the other side, the feminist whore police investigator cant wait to interogate your ass for 4 HOURS STRAIGHT, while you have to continue to repeat ” I have nothing to say, am i free to leave”. Canada, precisely Quebec, has a “very male friendly” justice system so take your chances.

    • Danger & Play Blog

      Sounds hectic. Is it over?

      • DoubleLongDaddy

Not yet, I mostly feel sorry for my parents. They dont deserve to hear this shit, good people, who love me, they feel freaking fucked over by the system.

  • Equanimity and Sophrosyne

I was on my way home about midnight, having spent a fantastic XXX rated evening with a fine young woman. I’d noticed one of the headlights of my Camero had gone out so I wasn’t surprised when a cop passing by whipped around and pulled me over. Pretty routine stop, I’ve been pulled over before, I figured I’d get a ticket and be told get it fixed and signed by the mechanic and everything would be cool. Then I’m blindsided by “Sir you’re acting pretty nervous are you ok?” My spine tingles. I stammer a bit.

“Have you been pulled over before?”

I’d been up about 20 hours at this point, if anything he could have hit me for fatigued driving or ability impaired. I also had the least little pot buzz, so I was pretty zen. Anything but nervous.

“Alright buddy” he says all cool (I’d been red pill long enough to pick up on scripts, this sounded pretty suspicious) “I don’t want to have to call the K9 unit in, so whatever drugs you have in the car, just level with me, and we can go easy on you in court, but you know what (he gets stern) you make me have to fool around, and I’m not gonna be nice. So I’ll ask you this once, what’s in here?”

I’m flabbergasted. I explain maybe some aspirin, dramamine, and caffeine pills in my glove box.
“Officer I say this with utmost respect, I have no drugs, I…. just had the best sex of my life, I’m very tired, I have to be up early to milk cows, I just want to get to bed.” I’m not sure he even heard me because he asked me to step out of the car, then he asks to search my car. Nothing about putting hands on the car but I did it anyway. Wasn’t searched or padded down either (That I recall) I know I’m supposed to say no and that he’d have to get a warrant. But I am 90% certain the car is clean (I’d had way too much ontology and such banging around my head, I’d only had it a few months, a skeevy previous owner may have left something, etc) so I say yes. I was being very, very, VERY careful to use slow easy apparent movements. I was surprised I wasn’t handcuffed, something I wasn’t looking forward to because they clamp the things down so hard. I was told to go sit on the bumper of his car, so I s-l-o-w-l-y walked on egg shells back to it, probably looking like a cartoon character trying to sneak. It got downright surreal when a huge group of hot college girls went by on the sidewalk. For a split second I thought of hamming up the bad boy vibe and asking for numbers to call from jail. Meanwhile the cop ransacks my car, finds my useless radar detector that doesn’t fit in my accessory port under the seat, an open box of magnum condoms, another still in the plastic, a big almost empty bottle of lube, and a big plastic mattress protector wrapped up with most of said lube on it. Probably a Dungeons and Dragons book or two as well. I bet he was happy he had his latex gloves on.

He comes back. “You haven’t been doing any drinking this evening have you?” For some retarded reason I offered that I had a few puffs of marijuana at a party. He nods. “Get back in your car and sit.” A few minutes later he comes up to my window “Get the headlight fixed” tosses the paperwork back in all rumpled up, walks back to his car and drives off. I can’t shake the thought that either he was a rookie and this was an exercise or that if I happened to be a few skin shades darker I could have been pretty close to being a grease-stain on the road.

I’m not sure what, or even if there is, a moral of the story would be. The guy was a dick and had axes to grind, but on the other hand only my poor registration and insurance card came out worse for the wear. I later learned both the city I was coming from and the one I was pulled over in are having a heroine epidemic. I have no idea if this was a ham fisted seize and search because I matched a profile or if they need a quota or if I did just enough right to keep my ass out of the fire.

On another note, I’ve read that a good way to “insure” yourself against rape charges after the first time or two is to take her out to breakfast, make sure the staff sees her all happy and such and keep the receipt. How far would that or similar concrete alibis get in establishing innocence? What would some further steps be?

hey mike! this is gold right here. Definitely need a few more on this topic. I have a few questions.
    1. If I have a conversation with the police and he decides to go on and lie, what really is stopping him from lying anyways even though if I don’t utter a word to him?
    2. What should us guys do pre/post sex to make sure that we have something backing us up against a FRA? (i.e texts (what type anything specific that could particularly help in court)
    3. Could you perhaps go into detail that how all these men are getting charged even though when there is no evidence? Like no vaginal tear etc. And if a guy straight up says he did not have sex, then what exactly brings the hammer down against him?

  • Basil Ransom

Mike, I recall hearing that filming sex without consent is illegal, albeit a lesser crime than rape, but that video captured by an ‘always on’ home security system that caught sex on tape would not necessarily violate the ‘filming without consent’ rule.

Is this correct? Could you be penalized for video captured by a passive always on home video setup?

  • XCSkierBen

    This is excellent Mike.

Here’s a tip for some young men as well. This comes in at quite a bit less than a rape accusation but it is important nonetheless.

Watch your ass at work. If you are in a corporate environment. Watch what you say and watch how you interact with women. This may sound “beta” but if your livelihood comes from a corporate environment, you need to watch yourself around certain women. Even women you THINK you can trust, stay clear of any sexual innuendo or joking. Keep it strictly business. Take it from someone who learned a LONG time ago that even the most harmless of comments can send someone over the edge.

    Good stuff Mike.

  • Dman

Great stuff Mike. Maybe what guys would be interested in is a super brief synopsis of relevant 4th amendment law relating to traffic stops and the like. What police can and can’t do; what they can and can’t search, etc. Crim Pro teaches you that you have far fewer rights than you might imagine.

Good podcast, definitely tuning in for the next part.

I’ve had a false accusation made against me. Three times, same bitch I’d broken up with. First time London copper rang my mobile and told me he’d investigated, found no evidence, but still wanted to see me. He came round with some female. They had a polite chat. No charges would be brought. Asked him why they was even telling me. Told me its his duty, did I prefer that he handcuffed me instead. I said yes, I’d like to cash in on some false arrest and imprisonment. Second time, same drill, another cop rang my mobile, told him he’d investigated, found no evidence on a separate false accusation. Told him to never ring me with such nonsense and spoil my day. Third time they did not even contact me, just saw the shit mentioned in some stupid report made by the bitch about how I’d broken up with her, claiming all sort of bile and lies. Now, I decided to turn the tables on her, asked the cops to look into ‘defeating ends of justice’ charge against the ho, and ‘misusing police time’. They told me to piss off. So brothers, watch your back, when you break up, make it clean and tight. And if you can, please get off facebook, its nothing but trouble.

    Mike:

What is your view of audio recording all sexual interactions with temporary partners? I suspect your view might differ if you are in a one party vs all party recording consent state. Having said that, even in an all party consent state, I think I’d rather take the risk of a wire-tapping conviction over the threat of a long rape trial. If you do think that this isn’t a horrible idea, how would you suggest archiving the recordings so that they are useful (e.g., ensuring that they are date and time stamped)?

Also, I keep records of all of my electronic communication with women (text, voicemail, email), and I have taken to sending a text out after we part in the AM saying something like “I had a lot of fun last night”. Hopefully (and usually) the woman responds, but even if she doesn’t, my thinking is that the text goes to my state of mind. Any thoughts?

    Thanks.

    Jack

BTW: I just realized that you touched on these points to a certain extent in a prior article. Oops.

Yeah, I cover a lot. It’s hard to keep up. I need to slow down the pace of postings so guys can get caught up.
